Article 1: Name
The name of the society shall be named and called as “Chhetri Samaj UK’’ (hereinafter shall be referred to as “Society” and in short abbreviation known as ‘’CSUK’’)
Article 2: Registered Office
The registered office of the Society will be situated in the UNITED KINGDOM. The official address of the Association shall be determined by the committee
Article 3: Objectives
The Society has following objectives as referred in Article 3. The Society
3.1 shall actively integrate and help Nepalese people residing in the UNITED KINGDOM with social problems issues and observe of social norms and values
3.2 Shall coordinate with social organizations for common social welfare services in UNITED KINGDOM
3.3 Shall provide moral and welfare support where possible to relieve help for relief of victims of fire, flood or others natural calamities and for those in need in the UNITED KINGDOM and Nepal
3.4. Shall organize charitable activities for relief of human sufferings of the poor, elderly people, the disabled, the sick or any other the people in need in the UNITED KINGDOM and Nepal
3.5 Shall organize activities for provisions of books, common equipments and students’ facilities to non-profit making schools, colleges and universities in UNITED KINGDOM
3.6 Shall actively promote and nurture the Nepalese Language, Arts and
Culture
3.7 Shall function as a non-profit organization
3.8 Shall promote the goodwill, assist and maintain cordial relationships with Nepalese community and with other associations in the UK
3.9 Shall associate with the Nepalese multicultural Society and shall promote
Inter-cultural activities
3.10 Shall promote Nepalese language development classes amongst children and adults of Nepalese community
3.11 Shall organize, promote & sponsor cultural, educational, recreational, musical, literacy and sporting events, festivals, pageants and conventions to promote the objectives of CSUK
3.12. Shall organize cultural, recreational and musical events to promote young talent in the community and bring awareness among young generation about Chhetri cultural heritage
3.13. Shall raise, solicit, collect, and disburse funds for charities, collect donations for cultural, educational and charitable purposes either directly or in cooperation with other non-profit organizations in the UK and Nepal
3.14 Shall comply with Race Relations Act and other relevant legislations in the UK
Article 4: The Purpose of funds
The funds of the Society, howsoever derived or obtained shall be applied solely towards the costs and expenses incurred in the attainment of any or all of the objectives of the Society as stipulated in Articles 3.1 to 3.14 of this constitution and no portion thereof shall be paid or transferred directly or indirectly to the Members of the Society
Article 5: Membership
5.1 Categories of membership
The Society shall consist of Ordinary Members, Honorary Members and life members. The annual membership of ordinary member fee shall be determined by the executive committee
Article 6: Ordinary Members
6.1 Any person or institution shall be ordinary Members.Ordinary Members of the Society shall be such individuals of Nepalese origin residing in the UK who are referred in Article 8 of this Constitution
(a ) Those who fulfil the criteria listed in Article 8 will be ordinary members and wish to become such members may apply to the Executive Committee of the Society as long as they duly pay their subscriptions
(b) The form for application of Ordinary membership of the Association shall be as prescribed in Appendix A
Article 7: Honorary Members
7.1 Honorary Members may be bestowed by the Society through the Executive Committee upon any person or institution with significant contributions to the Society or have distinguished work in social services
Article 8: Membership Procedure
Any person who fulfils the following requirements may apply to become member of the Society: , as follows
.8.1 A person aged 18 or over residing in the UK, subscribing to the objectives of society, willing to abide by the Constitution, is entitled to become a member of the society upon payment of prescribed fees as determined by the General body from time to time, subject to the conditions set forth in Article 9, will be ordinary members
8.2 The application forms must be supported by the recommendation of two members of the Society. Upon approval of the application by the Executive Committee and the payment of the prescribed fees, the applicant shall become the Ordinary Members of the Society
8.3 Any professional, academic or institution in the UNITED KINGDOM, which is interested in social services, may qualify for Honorary Members
8.4 All members shall furnish their full name(s), along with all family member
details, address, telephone number and email. He/she shall inform the Secretary of
the society in a timely fashion of any changes
Article 9: Membership Fee
9.1 INDIVIDUAL ORDINARY MEMBER
A person aged 18 years or above shall be eligible to become a SINGLE ORDINARY MEMBER of society by submitting an application in the prescribed form with appropriate fees. The annual SINGLE MEMBERSHIP fee shall be determined by the General body. A SINGLE MEMBER shall enjoy all basic privileges of CSUK membership, including the right to contest (for executive committee only) and vote in general elections
9.2 FAMILY MEMBER
A person or a family shall be eligible to become a family member of CSUK by submitting an application in prescribed form with appropriate fees as determined by the general body. FAMILY MEMBERSHIP consists of member, spouse, children (including dependant children and unmarried) and dependant parents living at the same address as the member
The annual FAMILY MEMBERSHIP fee shall be determined by the general body. FAMILY MEMBERS shall enjoy all basic privileges of CSUK membership excluding the right to contest (for executive committee only) and vote in general elections
9.3 With the exception of Honorary Members, all members of the Society shall, upon admission to membership, pay an entrance fee at a rate as prescribed by the Society acting in General Meeting from time to time
9.4 All members of the Society except Honorary Members shall pay annual subscription at rates as prescribed by the Society acting in General Meeting from time to time
9.5 The annual subscription shall be due on 1 January each year for the year commencing on that day
9.6 LIFE MEMBER
9.6.1 A person or a family shall be eligible to become a LIFE MEMBER of CSUK by submitting an application in prescribed form with appropriate fees. The life membership fee shall be determined by the general body. Life members shall have all basic privileges of CSUK membership, including the right to contest and vote in general elections. They are also eligible to stand and vote for board of trustees as well as executive committee
9.6.2 Life membership can also be paid on installment basis within a year
Article 10: Membership Cessation
10.1 A member shall remain in good standing provided that a member is not more than 6 months in arrears of the membership fee. Any members whose annual subscription remains unpaid for six months after the due date shall cease to be a member on 1 June of the same year and his/her name shall be removed from the Register
10.2 A membership term for all members begins from the date of membership. Membership is considered active, when membership fee is paid on or before 1st July in that particular year. Life members shall be member of CSUK for their entire lifetime
Article 11: Members’ rights and obligations
11.1 Ordinary member shall be entitled to take part in the activities of the Society including elections
11.2 Every member shall have the right to participate in the activities and to enjoy the facilities of the Society and have the right to be elected into the Executive Committee
11.3 Only ordinary Members are eligible to vote. Each of them shall have one vote. Such members are hereinafter shall be referred to as the Voting Members. A single member will carry one vote; a family and life member will carry more than two votes inluding family as referred in Article 9. 2
11.4 All members must observe and comply with the Constitution of the Society and the rules and regulations issued by the Society from time to time
11.5 All Members except Honorary Members shall pay the prescribed membership fees
11.6 Any Member who wishes to withdraw his membership shall inform the Executive Committee in writing
11.7 No Member shall use the name of the Society in his own personal dealings or shall attempt to bring the name of the Society into disrepute with malicious intent.
11.8 A member in good standing, for at least two consecutive years, is entitled to contest the elections to the Executive Committee
Article 12: Authority
12.1 The supreme authority of the Society shall be vested in the General Meeting and Executive Committee shall be the executive body. The General Meeting shall possess the highest authority in all matters affecting the body. The General Meeting shall be classified as an Annual General Meeting and Extraordinary Meetings.
Article 13: General Meetings
13.1 An Annual General Meeting shall be held once in each and every calendar a year at such time and place as may be determined by the Executive Committee. The time elapsed between any two successive Annual General Meetings shall not exceed 18 months. All other General Meetings shall be called Extraordinary General Meetings
13.2 Notice of the Annual General Meeting shall be sent to all Members in writing six weeks before the meeting
13.3 The quorum of any General Meeting is ten Voting Members. If a quorum is not present at any Annual General Meeting, then the Executive Committee shall give at least seven days notice of the date, time and place of the adjourned meeting, and if at the adjourned meeting a quorum is not present within half an hour from the time appointed for the meeting, the Voting Member or Voting Members shall be a quorum.
13.4 The functions of the Annual General Meeting shall be
a. To receive and adopt the Annual Report of the activities, to review the past work of the Society, and to discuss future policy;
b. To receive and adopt the Financial Report
c. To elect Members of the Executive Committee for the ensuring terms of the office
d. To discuss any other items on the agenda at the time of calling the meeting
13.5 An Extraordinary General Meeting shall be convened in case of at the request of the Executive Committee, or at the request of not less than one-fifth of the total number of Members of the Society
13.6 All questions submitted to a General Meeting, except amendments of the Constitution or dissolution of the Society shall be decided by a simple majority of votes. In the event of an equality of votes the Chairman shall have a casting vote
Article 14: Executive Committee
14.1 Two types of executive bodies shall be formed
(a) Central Executive Committee
(b) Province Committee
The Central Executive Committee shall be referred in Articles 14.2 to 14.13 . The Province Committee shall be referred in Article 19
14.2 The Central Executive Committee shall consist of Chairman, Vice-Chairman, General Secretary, Joint Secretary, Treasurer, Joint Treasurer, Public Relation Secretary, Cultural Secretary and 11 Members. All Members of the Executive Committee shall be elected by the General Meeting according to this constitution
14.4 Membership is not transferable to others
14.4 The office of any member of the Executive Committee shall become vacant if that Member
a. Becomes a salaried staff of the Society
b. Become bankrupt
c. Becomes of unsound mind
d. Resigns his office by one month’s notice in writing to the Society
e. Is convicted of an indictable offence
f. Is removed by the Society in General Meeting
14.5 The functions and powers of the Executive Committee shall be
a. To plan and organize the overall activities of the Society
b. To implement the resolutions passed by the General Meetings
c. To fix the financial year of the Society
d. To prepare the annual budget
e. To attend to the day to day affairs of the Society
f. To take decision on staff employment, termination and salary
g. To make the recommendations to the General Meetings
14.6 The Chairperson shall
a. Represent the Society
b. Direct the various Members of the Executive Committee
c. Take overall charge of the work of the Society
d. Preside over all Executive Committee and General Meetings
e. Present at the Annual General Meeting an Annual Report , on behalf of the Executive Committee
14.7 The Vice-Chairpersons shall
a. Assist the Chairperson in his work
b. act as Chairperson in his absence
14.8 The General Secretary shall be responsible for
a. The administration of the Society
b. The safe keeping of seal and chops of the Society
c. The keeping of an up-to-date Register of Members
d. Sending notices, preparing agenda and to keep all minutes of the meetings
14.9 The Joint Secretary shall be responsible for
In the absence of the General Secretary the Joint General Secretary shall carry out the duties of the General Secretary
14.10 The Treasurer shall
a. Be responsible for all funds of the Society and shall prepare an annual budget for the approval of the Executive Committee
b. Ensure that funds of the Society are only used to meet the regular expenses of the Society
c. Arrange to have all membership subscriptions and donations paid into the account of the Society opened in a bank
d. Arrange the book-keeping and shall keep full and accurate accounts
e. Hold an imprested account not exceeding 500 pounds
f. Prepare the annual statement of accounts
g. Give an annual financial report at the Annual General Meeting
h. Shall maintain an account of the income and expenditure of the society,. issue receipts for all cash received by the society and keep in proper custody of all receipts and bills for expenses incurred by the society.
14.11 The Joint Treasurer shall be responsible for
In the absence of the Treasurer the Joint Treasurer shall carry out the duties of the Treasurer.
The Joint Treasurer shall liaise with Treasurer and shall receive and have the custody of the funds of the society and shall invest and disburse them subject to the rules and under the direction of the Executive Committee
14.9 Meetings of the Executive Committee shall be held at such times and places as the
Chairperson may appoint and there shall be at least one meeting in each quarter. The quorum of
an Executive Committee shall consist of seven Members of the Executive Committee
14.12 The Public Relation Secretary shall be responsible for
a) Organise seminar, symposia, and conference to promote the cultural heritage of Society and to enhance cooperation between Nepal and the UK
(b) Work out to update website, responsible for various publications in cultural heritage and promote the objectives of the Association
14.13 The Cultural Secretary shall be responsible for
a) Improving the quality of life for all through cultural and sporting activities and maintain to support the pursuit of excellence art and culture of community
b) Humanitarian assistance in the event of a disaster or natural calamities
c) Working with local and regional government to improve the delivery of cultural services,
d) Liaised with Chhetri Samaj in Nepal
e) Seeking to integrate priorities for the protection, enhancement and access to Chhetriya culture
Article 15. Debts and Liabilities
15.1 All debts and liabilities of the Society shall be borne equally by all members during whose term of Membership such debts and liabilities are incurred
Article 16: Dissolution of the Society
16.1 The Society shall not be dissolved, except with the consent of three quarter of all Voting Members present at the General Meeting convened to discuss the matter
16.2 In the event of dissolution, any assets of the Society will be donated to charitable organizations approved by the Society acting in General Meeting
Article 17; Amendments to the Constitution
17.1 Any amendments to this Constitution shall require the approval of at least two-thirds of the Voting \Members present at the General Meeting. Any of these Rules may be rescinded or amended by a resolution passed at any general or special general meeting of the Society by a two-thirds majority of the Ordinary Members present and voting; provided that
(i) Such a majority shall consist of not less than 51% Ordinary Members present and voting
(ii) Notice of such resolution, stating the nature of the proposed alternation and the names of the proposed and supporter, shall have reached the General Secretary at least fourteen days before the date fixed for the meeting
(iii) In the event of a resolution being passed to rescind or amend any part of Articles , such resolution shall not be effective until confirmed by a simple postal ballot to be conducted within two months after the date of the meeting at which
Article 18. Notices
18.1 All notices shall be in writing and shall be deemed received, when sent by the prepaid post addressed to the recipient in UNITED KINGDOM, 4 days after posting, and in case where the recipient lives abroad, 7 days after posting
Article 19: Province Committee
19.1 A society that has members in a number of regions may establish Province committee. A society may submit an application to incorporate a Province, or a number of branches may be incorporated as a group. In either case there must be a minimum of 100 members, a majority of who consent to the application for incorporation. Where incorporation is sought as a group, the majority of each branch within the group must consent to the application
19.2 Each UK Borough shall be considered as a Province. However, if a Borough does not have enough members to form a Province, alternatively two or three boroughs, proximity to each other, may submit an application to incorporate a Province committee
19.3 A Province Committee shall submit 20% of its income to the central executive committee
19.4 Each Province Committee shall select and recommend at least 3 members’ among the members in their area within or outside the Province Committee to be nominated as their area representative
19.5 Upon the recommendation of the Province Committee from various geographical regions, an Area representative shall be nominated by the Central Executive Committee by their majority vote
19.6 In pursuant to Article 19.5, if no clear majority vote obtains, the chairman shall cast his deciding vote to nominate an area representative in the region
19.7 Under direct coordination and supervision of the Area representative, he/she can facilitate to form a Province Committee in Borough in accordance with the direction of the Central Executive Committee
19.8 Whereby the Central Executive Committee shall feel to form an unit committee in Borough, the Central Executive Committee shall have power to nominate directly any area representative in their discretion if it is required to do so
19.9 Each Province Committee shall draft their own constitution in accordance with this Constitution. If any parts of Province’s constitution contravenes with this constitution shall be automatically rendered null and void
19.10 Each Province Committee shall inform its all activities to the Central Executive Committee. Each Province Committee shall act in accordance with direction of the Central Executive Committee
Article 20: RESOLUTION OF DISPUTES
20.1 Any disputes arising out of the interpretation or application of these Rules or concerning the election of office bearers or the executive committee members of the Association or the operation of the Association shall be referred to a tribunal of three distinguished members of the Nepalese community in the UK chosen by the general meeting and their decision would be final
Article 21: PATRONS
21.1 Executive Committee may appoint (subject to ratification by the general meeting of the Association) a patron or patrons not exceeding three in total from among the people of sufficiently high standing who have made a significant contribution to the Society
Article 22: ADVISORY COUNCIL
22.1 The Executive Committee may establish an advisory council and appoint leading positions in order to support the Society in various forms and to serve in such a Society for a term determined by the Executive Committee
Article 23: CO-OPTED MEMBERS OF THE EXECUTIVE COMMITTEE
23.1. The Executive Committee may from time to time co-opt, for any period not exceeding two years, not more than five ordinary members of the Association to serve on the Executive Committee, and may renew such appointments from time to time
Article 24: CODE OF CONDUCT
24.1 All members of the Society shall abide the following code of conduct as a condition of their membership
a) In accordance with aims and objectives of CSUK, it is imperative for each and every member to respect fellow members and maintain professional behaviour at all times and in all kinds of communications
(b) To uphold and promote the objectives of the Association as prescribed in Article 3 of this Constitution
(c) Not to carry out any activities this would be detrimental to the Society or shall go against the decisions of the Executive Committee or the general meeting
(d) To maintain a high professional ethics, personal integrity, and general standards of behaviour in providing cultural services to any members of the public
(e) To confirm the general code of conduct prescribed by the relevant professional and regulatory bodies in the UK
(f) Not to carry out any activities that will bring disrepute to the Society; and
(g) Not to use any affiliation with the Society in any improper manner
Article 25: Expulsion
25.1 Any member of the Association who may be guilty of any conduct which, in the opinion of the Executive Committee renders her or his membership detrimental to the interests of the Association may be requested to resign. If he/ she refused to do so may be expelled by a resolution of the Executive Committee, subject to an opportunity being given to her or him to explain her or his conduct. Any such resolution shall require a majority of not less than two-thirds of the Executive Committee present and voting
Article 26: THE EMBLEM OF THE ASSOCIATION
26.1The emblem of the Association shall be as designated by the Executive Committee of Society
Article 27: APPLICABLE LAW
27.1 The Laws of England shall apply to the matters relating to the Society‘s activities
